Under Section 13B of the Hindu Marriage Act and Section 28 of the Special Marriage Act, a mutual consent divorce typically takes 6 to 8 months. The law requires a 6-month “cooling-off” period between the First Motion (when the petition is filed) and the Second Motion (when the final decree is granted).

2. What happens if my spouse refuses to agree to a mutual divorce?
If your spouse refuses to cooperate, you will need to file a “Contested Divorce.” You must prove specific legal grounds to the court to be granted a divorce, such as physical or mental cruelty, adultery, desertion (abandonment for at least two continuous years), or an incurable mental disorder.

4. How does the court calculate alimony or maintenance?
There is no fixed mathematical formula for alimony in India.
